These Terms of Service ("Terms") are a legal agreement between you and Base Origin LLC ("Base Origin," "we," "us," or "our") governing your access to and use of our games, applications, and website (together, the "Services"). By downloading, installing, accessing, or using any of our Services, you agree to be bound by these Terms. If you do not agree, do not use the Services.
1. Eligibility
You must be at least 13 years old (or the minimum age required in your country to use the Services) to use the Services. 4. Virtual items and purchases
The Services may let you purchase virtual currency, items, or other content ("Virtual Items") using real money. Purchases are processed by the Apple App Store or Google Play under their terms.
- Virtual Items are licensed to you, not sold, and have no monetary value and cannot be exchanged for real money or transferred outside the Services.
- All purchases are final and non‑refundable, except where required by law or under the applicable app store's policies.
- We may manage, change, or remove Virtual Items or their pricing at any time.
5. Intellectual property
The Services, including all games, artwork, characters, names, logos, audio, code, and other content, are owned by Base Origin or its licensors and are protected by intellectual property laws. "Base Origin" and "Supertanker TD" are trademarks of Base Origin LLC. Nothing in these Terms transfers any ownership rights to you.
6. Feedback
If you send us ideas, suggestions, or feedback about the Services, you grant Base Origin a perpetual, irrevocable, worldwide, royalty‑free license to use them for any purpose without any obligation or compensation to you.
7. Updates and availability
We may update, change, suspend, or discontinue any part of the Services (including features and Virtual Items) at any time, with or without notice. We are not liable to you for any such change or discontinuation.
8. Termination
You may stop using the Services at any time. We may suspend or terminate your access to the Services if you violate these Terms or if we discontinue the Services. Provisions that by their nature should survive termination (including Sections 5, 6, 9, 10, and 11) will survive.
9. Disclaimers
The Services are provided "as is" and "as available" without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non‑infringement. We do not warrant that the Services will be uninterrupted, error‑free, or secure. Some jurisdictions do not allow certain warranty exclusions, so some of the above may not apply to you.
10. Limitation of liability
To the maximum extent permitted by law, Base Origin and its owners, employees, and partners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising out of or related to your use of the Services. To the extent permitted by law, our total liability for any claim relating to the Services will not exceed the greater of the amount you paid us in the twelve months before the claim or USD 50. Nothing in these Terms limits liability that cannot be limited under applicable law.
11. Indemnification
You agree to indemnify and hold harmless Base Origin from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your misuse of the Services or your violation of these Terms or applicable law.
12. Apple and Google app stores
If you download a game from the Apple App Store: these Terms are between you and Base Origin only, not Apple, and Apple is not responsible for the Services or their content. Apple has no obligation to provide maintenance or support for the Services. Apple and its subsidiaries are third‑party beneficiaries of these Terms and may enforce them against you. Similar terms apply where you download from Google Play, in accordance with Google's applicable policies.
13. Governing law
These Terms are governed by the laws of the United States and the State of Wyoming, without regard to conflict‑of‑law rules. You agree that any dispute will be resolved in the state or federal courts located there, except where applicable consumer‑protection law grants you the right to bring proceedings in your country of residence.
14. Changes to these Terms
We may update these Terms from time to time. When we do, we will revise the "Last updated" date above and, where appropriate, provide additional notice. Your continued use of the Services after changes take effect constitutes acceptance of the updated Terms.
